How to Fire Your Attorney

Firing your attorney depends upon whether your case is before the courts or is in a pre-litigation stage. If your case is before the courts (that is, a lawsuit has been filed), a substitution of attorneys form must be filed with the court to inform all parties that you are no longer employing the original lawyer.

If no lawsuit has been filed, you are not obligated to inform your attorney that you are substituting him or her. You may simply look for another personal injury attorney and they will inform your old attorney of the substitution.
